Who Is Liable for a Commercial Truck Accident?

| Oct 10, 2018 | Personal Injury

The possibility of a severe large truck or tractor trailer accident occurring on our nation’s roadways, highways, and interstates is a constant reality. In 2016, there were 4,440 crashes involving large trucks or buses throughout the nation, a two percent increase from the year before.

Smaller passenger vehicles must share the road with large commercial vehicles such as tractor trailers and corporate delivery vehicles that transport goods throughout Tennessee. Unfortunately, these smaller vehicles have a distinct disadvantage in terms of weight and size when they are involved in a trucking accident.

It is vital for those injured in a truck crash, through legal counsel, to establish the liable parties. Liability can be a little more complex in large truck and tractor trailer accidents as opposed to standard passenger-car-to-passenger-car crashes. In a truck crash, often the liable party is the truck driver. Liability may also rest with other parties, including the owner of the trucking company, the vehicle part manufacturers, and other entities in the chain of commerce, just to name a few.

In addition, third-party maintenance vendors are often responsible for maintaining tractor-trailers. These companies may be liable if negligent maintenance on their part is demonstrated.

Finally, it may be the local government itself which shares some of the blame. For example, if the collision was the result of a hazardous roadway, or by a government employee who was driving the commercial truck, you may be able to file a claim against the town or state. These claims are tricky, though, so make sure to call us right away.

Physical and financial aftermath of a large truck accident

Depending on the severity of a trucking accident, you and your family could face long-term issues, both physically and financially due to your injuries. The financial burdens can include immediate medical bills, lost income, future lost wages, replacement costs for your vehicle, and other costs related to your ongoing care. In addition, your injuries may force you to endure physical pain and discomfort as well as inordinate amounts of time for recuperation and rehabilitation. The result of all of these issues can threaten your financial position and take away many of the comforts and conveniences of life that so many take for granted.

A seasoned truck accident attorney can take care of the legal issues involved, including the effort to obtain a just settlement on your behalf for your losses, while you focus on recovering from your injuries.
